China Trademerk - Trademark theft has become a very common occurrence in China. Many companies who exhibit at trade shows or promote their products through Chinese ecommerce platforms are highly exposed to Trademark theft.

China operates a first to file system so Individuals will see a trademark name or a logo, copy it and then register it with the Chinese Trademark bureau. When the company goes to apply to register its trademark in China it will then discover that the trademark is already taken. When the individual is contacted by the company, they may seek a compensatory payment for assigning the trademark to the company.

 

Goodada's China Trademark Application Process

Step 1 Contact Goodada
Step 2 Submit to Goodada the names and, logos which you wish to get trademarked in China.
Step 3 Goodada will check with the Chinese Trademark office if the desired names & logos are availability in China.
Step 4 Goodada will issue a report on its findings on name and logo availability.
Step 5 Client selects an available trademark name.
Step 6 Client provides Goodada with supporting documentation for the Trademark application: Documents include Business License, company owner details etc.
Step 7 Goodada translates these documents into Chinese.
Step 8 Goodada prepares the Trademark Name application form for the client
Step 9 Goodada submits the application with the China Trademark Registration Bureau (CTRB).
Step 10 CTRB 3 Stage Approval Process. (circa 17 months):

Phase 1 (+3 months post application) – CTRB provide initial approval/ rejection feedback.

Phase 2 (+12 months post application) – CTRB provide 2nd round approval/ rejection feedback.

Phase 3 (+17 Months post application) – CTRB issues a certification or rejects application.

**Note the Certification is usually valid for 10 years**
Step 11  Register Trademark with Chinese Customs to prevent and halt any movement of illegally branded products moving through Chinese ports.

 

**Important background information about applying for trademarks in China**

  • In China the first person to file an Trademark will own that right when granted.
  • It is vital to claim to register your trademark in China so that your brand can be protected.
  • The Chinese trademark service usually do not accept names which include the names of products, generic words or place names.
  • The trademark application process takes about 18 months.

 

Costs & Fees

  • Trademark Name Research: €65 per trade mark name.
  • CTRB Application: €1,750 per trademark name category application.
  • China Customs Registration Fee: €750 per name.
